On January 20, 2004, the United States District Court for the Western District of Texas denied the motion of Universal Express and its subsidiaries, Private Postal Network.com Inc., Universal Express Logistics, Inc. Worldpost International Delivery and Universal Express Capital Corporation to dismiss the jurisdictional motion in the trademark suit against Universal Express and its subsidiaries, Private Postal Network.com Inc., Universal Express Logistics, Inc. Worldpost International Delivery and Universal Express Capital Corporation for infringment of the registered WORLDPOST trademark. The case against Universal Express and its subsidiaries, Private Postal Network.com Inc., Universal Express Logistics, Inc. Worldpost International Delivery and Universal Express Capital Corporation is set for a jury trial in San Antonio, Texas on September 13, 2004. Worldpost is seeking to enjoin Universal Express and its subsidiaries, Private Postal Network.com Inc., Universal Express Logistics, Inc. Worldpost International Delivery and Universal Express Capital Corporation from all use of the WORLDPOST registered trademark and recovery of damages and attorney fees.
